1. Service Description

eSims Max is a global eSIM reseller that provides digital eSIM data plans for travelers. Our service allows you to purchase and activate data plans for use in 200+ countries worldwide. All products are delivered digitally — we do not ship physical goods. Upon purchase, you will receive a QR code or activation details to install the eSIM profile on your compatible device.

2. Account Registration

To use our services, you must:

• Be at least 18 years of age
• Provide accurate and complete registration information
• Maintain the security of your account credentials
• Notify us immediately of any unauthorized access to your account
• Accept responsibility for all activities under your account

We reserve the right to suspend or terminate accounts that violate these Terms or provide false information.

3. Payment Terms

Pricing

All prices are displayed in US Dollars (USD) and include applicable fees. Prices are subject to change without prior notice. The price displayed at the time of purchase is the price you will be charged.

Refund Policy

Due to the digital nature of our products, refunds are limited to the following circumstances:

• The eSIM profile fails to install due to a technical error on our end
• The eSIM does not activate or provide connectivity in the purchased destination, and our support team is unable to resolve the issue
• Duplicate charges resulting from a payment processing error

Refunds will not be issued for:

• Change of mind after purchase
• Device incompatibility (it is your responsibility to verify compatibility before purchase)
• Unused data or early plan expiration
• Partial data consumption
• Issues caused by incorrect device settings or user error

Refund requests must be submitted within 7 days of purchase to admin@esimsmax.com.

4. Acceptable Use Policy

You agree not to:

• Use our services for any unlawful purpose or in violation of any applicable laws
• Resell, redistribute, or commercially exploit our eSIM plans without written authorization
• Attempt to gain unauthorized access to our systems or other users' accounts
• Use automated tools to scrape, crawl, or extract data from our website
• Interfere with or disrupt the integrity or performance of our services
• Use eSIM data plans for activities that violate the network operator's acceptable use policies
• Engage in excessive data usage that constitutes abuse of fair usage policies

5. eSIM Activation and Compatibility

It is your sole responsibility to ensure your device is eSIM compatible before making a purchase. Not all devices support eSIM technology, and carrier-locked devices may not be compatible.

Before purchasing, please verify:

• Your device supports eSIM (check manufacturer specifications)
• Your device is not carrier-locked or SIM-locked
• Your device has available eSIM slots
• Your device is running a compatible operating system version

eSIM profiles are typically single-use and non-transferable. Once activated, they cannot be moved to another device. Plan validity begins upon first network connection in the destination country unless otherwise specified.

6. Service Availability

While we strive to provide reliable connectivity, we cannot guarantee:

• Uninterrupted network coverage in all areas of a destination country
• Specific network speeds (4G/5G availability depends on local infrastructure)
• Service availability during network outages, natural disasters, or force majeure events
• Compatibility with all local network operators in a given country

Coverage maps and speed estimates are provided for informational purposes only and do not constitute a guarantee of service quality or availability at any specific location.

7. Limitation of Liability

To the maximum extent permitted by applicable law:

• eSims Max shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of our services
• Our total liability for any claim arising from these Terms or our services shall not exceed the amount you paid for the specific eSIM plan giving rise to the claim
• We are not liable for any loss, damage, or inconvenience caused by factors beyond our reasonable control, including but not limited to network outages, device incompatibility, or third-party service failures

Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law.

8. Intellectual Property

All content on our website, including but not limited to text, graphics, logos, icons, images, software, and the overall design and arrangement, is the property of eSims Max or its licensors and is protected by intellectual property laws. You may not reproduce, distribute, modify, create derivative works of, publicly display, or exploit any of our content without our prior written permission.

9. Termination

We may suspend or terminate your account and access to our services at any time, with or without cause, including but not limited to:

• Violation of these Terms or our Acceptable Use Policy
• Fraudulent or suspicious payment activity
• Abusive behavior toward our staff or other users
• Extended account inactivity (12 months or more)

Upon termination, your right to use our services ceases immediately. Any unused eSIM data will not be refunded unless termination was due to our error.

10. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States. Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts located in the United States.
